Acceptance of Terms

Doyouok (doyouok.com) is operated by GCESoftware Pty Ltd ("Doyouok", "we", "us", "our"). By accessing or using Doyouok, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website or service.

Definitions

• "Service" means the Doyouok website and process monitoring service described below.
• "Check" means a monitored scheduled job, event-triggered process, or background task that you configure in your account.
• "Ping URL" means the unique URL generated for a Check, requested to record a Check-in.
• "Check-in" means a request to a Check's Ping URL indicating that the monitored task ran successfully or the monitored event occurred.
• "Plan" means the subscription tier (e.g. Free, Starter, Pro, Agency) applied to your account, which determines your quotas and features.
• "Billing Period" means the recurring monthly or yearly cycle for which a paid Plan is charged in advance.

Service Description

Doyouok is a process monitoring ("dead man's switch") service: you create a Check for a scheduled job, event-triggered process, or background task and receive a dedicated Ping URL, which you request every time it runs successfully or the event occurs; if no check-in is received within the configured interval, we alert you via the notification channel(s) you have configured (such as email, Slack, Discord, Telegram, or a webhook).

Doyouok is not responsible for the outcome of the tasks you monitor — only for detecting whether check-ins arrive on time and sending alerts.

Account

You need to sign in with a Google account to create and manage Checks. You agree to:

• Be responsible for all activity under your account.
• Notify us immediately if you discover unauthorized use of your account.

Plans and Quotas

Different plans (e.g. the Free plan) impose different limits on the number of Checks you can create and the minimum check-in interval. We reserve the right to adjust plan quotas, and will publish any changes on the website.

If you downgrade to a plan with a lower Check quota than you are currently using, we will email you a notice. If your account is still over the new quota 7 days after that notice, we will disable your most recently created Checks in excess of the quota, starting with the newest, until your account is within the limit (for example, downgrading from 50 Checks to a 35-Check quota would disable your 15 newest Checks). Disabled Checks are not deleted and stop being monitored while disabled; they can be re-enabled by upgrading your plan or freeing up quota elsewhere on your account. We do not delete your account or your data for exceeding a quota.

Billing, Price Changes, and Cancellation

Paid plans (Starter, Pro, Agency) are billed in advance on a monthly or yearly basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle until you cancel.

We may change the price of a plan from time to time. For an active subscription, we will give you reasonable advance notice (at least 30 days) of any price increase; the new price will take effect from your next Billing Period, and continuing your subscription after that date means you accept the new price.

You may cancel your subscription at any time through the Stripe Billing Portal, accessible from your dashboard. Cancellation stops future billing; your plan remains active until the end of the current paid period, after which your account reverts to the Free plan. Except as required by the Australian Consumer Law or other applicable law, payments already made are non-refundable, including for partial or unused billing periods.

Acceptable Use

You agree to use Doyouok only for lawful purposes, and not to:

• Abuse the Ping endpoint with malicious requests unrelated to monitoring.
• Attempt to interfere with or disrupt the normal operation of the website or service.
• Scrape or bulk-access data on this website without authorization.

We reserve the right to suspend or terminate an account that violates these terms, without prior notice.

No Guarantee of Detection or Delivery

Doyouok will use reasonable efforts to detect missed check-ins and to send you an alert when a Check times out. However, you acknowledge and agree that we do not and cannot guarantee that:

• every missed check-in will be detected;
• an alert will be sent, sent without delay, or successfully delivered; or
• a delivered alert will actually be seen, opened, or acted upon by you.

Alert delivery depends on third-party systems outside our control (see "Third-Party Services" below), including email providers and spam filtering. You should not treat Doyouok as your sole safeguard for anything where a missed or delayed alert could cause serious harm — see "Prohibited Critical Uses" below.

Prohibited Critical Uses

Doyouok is a general-purpose process monitoring tool and is not designed, intended, or fit for use as, or as a substitute for, any system where a failure, delay, or missed alert could result in death, personal injury, or serious property, financial, or legal harm. You must not rely on Doyouok for, among other things:

• medical monitoring or life-support systems;
• emergency response, personal safety, or welfare-check systems;
• fire, security, or intrusion alarm systems;
• critical infrastructure or industrial control systems;
• time-critical financial transactions; or
• legal or regulatory compliance deadlines.

You are solely responsible for maintaining independent, appropriate safeguards for any critical process, and for assessing whether Doyouok is suitable for your use case.

Your Responsibility for Configuration

You are solely responsible for correctly configuring and maintaining your Checks, including the notification email address or channel, the Ping URL integration in your monitored job or task, and the check-in interval and grace period. We are not responsible for losses arising from your own misconfiguration, including but not limited to an incorrect or outdated notification address, a Ping URL that is not called correctly by your task, an interval unsuited to your task, or alerts filtered into spam or blocked by your mail provider.

Ping URL Security

A Check's Ping URL functions like a credential: anyone who obtains it can record a Check-in or otherwise affect that Check's status. You are responsible for keeping your Ping URLs confidential and for any consequences of a Ping URL being exposed, leaked, or used by someone other than you (for example, in public source code, logs, or client-side scripts). If you believe a Ping URL has been compromised, you should delete or recreate the affected Check.

Third-Party Services

Providing the service relies on third-party systems we do not control, including hosting infrastructure, DNS providers, email and notification providers, Google (for sign-in), Stripe (for billing), and the internet generally. We are not liable for any failure, interruption, delay, or data loss caused by the failure or unavailability of any such third-party service.

Availability and Disclaimer

Doyouok is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including but not limited to warranties that the service will be uninterrupted, secure, or available at any particular time, that errors or defects will be corrected, or that the service is free of viruses or other harmful components. We also do not warrant that using the service will meet your requirements.

This includes situations where a service outage, third-party failure, or your own misconfiguration prevents a check-in from being detected or an alert from being sent; to the maximum extent permitted by law, we are not liable for any losses resulting from missed or delayed alerts in such circumstances.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you under the Australian Consumer Law (ACL) or other applicable law that cannot lawfully be excluded, restricted, or modified. Where our services are not of a kind ordinarily acquired for personal, domestic, or household use, our liability for a failure to comply with a consumer guarantee under the ACL is limited, at our option, to re-supplying the service or paying the cost of having the service re-supplied.

Indemnification

You agree to indemnify and hold harmless Doyouok, its operators, and personnel from and against any claims, losses, liabilities, damages, and reasonable costs (including legal fees) arising out of or related to: your breach of these Terms; your misuse of the service; your violation of any law or third-party right; or content or configuration you submit, to the extent caused by you.

Limitation of Liability

To the maximum extent permitted by law, whether based on warranty, contract, tort (including negligence), or any other legal theory, Doyouok and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, data, use, or goodwill), even if advised of the possibility of such damages.

Subject to the Australian Consumer Law protections described above, our total aggregate liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) AUD $100, for claims by users on our Free plan or where no payment has been made.

Intellectual Property

Content on this website (text, interface design, logos, etc.) is owned by Doyouok and protected by copyright law. It may not be copied, distributed, or used for commercial purposes without written permission.

You retain ownership of the Check names, configuration, and any other content or data you submit ("Your Content"). You grant us a limited license to use, store, and process Your Content solely to provide and maintain the service to you.

Data Deletion; Not a Backup Service

When you delete a Check or your account, the related data is removed from our systems as described in our Privacy Policy and is not recoverable. Doyouok is a monitoring service, not a backup or archival service — you are responsible for independently retaining any records (such as check-in history) that you need for your own purposes.

Termination

You may cancel your subscription and stop using the service at any time as described under "Billing, Price Changes, and Cancellation".

We may suspend your account where we reasonably suspect a violation of the "Acceptable Use" section, non-payment of amounts due, or activity that risks harm to the service, other users, or third parties, and will where practicable attempt to notify you of the reason.

We may terminate your account for a serious or repeated violation of these Terms, for non-payment that remains unresolved after reasonable notice, or if we discontinue the service entirely (in which case we will provide reasonable advance notice where practicable). Upon termination, your right to use the service ends immediately and we may delete your account data in accordance with our Privacy Policy.

If we terminate a paid account for a reason other than your breach of these Terms, we will refund the unused, prepaid portion of your current billing period on a pro-rata basis; fees already earned for periods of service already provided, and terminations resulting from your breach, are non-refundable.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland (QLD), Australia. Both parties agree to submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising from these terms or your use of Doyouok.

Changes to These Terms

We may modify these Terms of Service from time to time. Material changes will be posted on this page along with an updated "last updated" date; continuing to use Doyouok means you accept the updated terms.
